TERMS & CONDITIONS FOR RENTING OF ROOM

1. Payment of Rental and Utilities charges
1.1 Tenant must pay rent as specified in the First Schedule at the beginning of each month, latest by the 7th of each month. Payment made after 7th of each month will attract a late payment interest of minimum RM10.00 or interest of 12% per annum whichever is higher. Default of one-month payment will result in eviction without notice and all deposit shall be forfeited. Thereafter Landlord shall repossess the room and tenant’s belonging will be removed and kept by the landlord with a custody fee and will be disposed of at the expiry of one-month period from repossession date without liability.
1.2 Interest shall be charged on late payment of rental at the rate of 1% per month.
1.3 Tenant shall pay the electricity charges in accordance to the bill provided by the Landlord every month.
1.4 The deposits paid for rental and utilities shall not be used to off-set rental due. The rental deposits shall be refunded to the tenant within 14 days and utilities deposit shall be refunded within 30 days upon expiry of the term hereby created less any sum as may then be due to the Landlord as utilities bills (electricity, water, internet plus other if any/or damages caused to the room fixture and fittings by the Tenant.
1.5 Tenant shall ensure the usage of water and electricity are kept to the minimal and must be on need basis. All electrical and water-based items have to be switched off when not in use. Tenant shall ensure that lights, fan or air-conditioner are switched-off before leaving the house. Any breach of this condition will be subjected to an on the spot fine of RM50.00.
2. Termination and Expiration of Tenancy
2.1 The minimum tenancy period is 12 months and the Tenant is required to give 2 months’ written notice for termination or payment in lieu thereof.
2.2 The landlord reserves the right to terminate the tenancy without notice if the Tenant is found to have breached any of the terms and conditioned contained herein.
2.3 In the event the Tenant terminates the tenancy before the expiry of the minimum tenancy period, the rental deposit shall be forfeited.
2.4 At the expiration of the tenancy, tenant must deliver the keys for all locks to the Landlord and yield up peaceably the Premises with the fixtures, fittings (such as lightings, doors, fan and air-conditioner units) and decorations thereto [other than the Tenant’s fixtures] in a tenantable repair and condition, fair wear and tear excepted.
2.5 If rental is in arrear after the 30th day from the due date, the Landlord shall be at liberty to enter the room and thereupon the tenancy shall absolutely be determined and all deposits paid by Tenant shall be forfeited to the Landlord but without prejudice to the right of action of the Landlord in respect of any antecedent breach of the conditions on the part of the Tenant.
2.6 The Landlord shall without prejudice to any other rights he has, be entitled to sue and take any other action that the Landlord deems fit to recover all monies due and owing to the Landlord and the costs and expenses of all such actions taken shall be borne by the Tenant.
3. Common Area
3.1 Rental is strictly restricted to the room area only. Area other than the room area will be deemed common area and reserved for intended usages only. Tenant is not authorized to use common area for any other purpose.
3.2 All common areas are to be kept free of belongings, clean and no storage of any item is allowed. Landlord has the right to dispose off any item in the common area without notice.
3.3 The Tenant shall ensure that the rooms and common areas are clean, tidy and in pleasant living condition at all times. All rubbish to be disposed of properly at the rubbish bin.
3.4 Tenant shall not leave their personal items at the common area (save for food in the pantry, washed wet clothes at the hanging area and shoes at the shoe racks)
4. Tenant’s Guests
4.1 No guest(s) of the Tenant is allowed to stay overnight at the premise without the prior approval from the landlord.
4.2 If such an event occurs, the landlord has the right to impose a fine of RM50.00 per day and/or terminate the tenancy without notice and the deposit shall be forfeited.
4.3 The tenant’s guests shall abide by the same rule as stated herein and respect the peaceful environment of the premise.
4.4 The responsibility and any action by tenant’s guests lie solely with the tenants. Tenants will be fully accountable and responsible for their guest’s action.
5. Prohibited Conducts
5.1 Tenant is not allowed to quarrel or fight. Offenders will be evicted immediately without notice.
5.2 Tenant is not allowed to consume alcoholic liquor and beer.
5.3 Tenant is not allowed to smoke in the house/room.
5.4 Tenant must not knock any nails or sharp object into the walls in the room or any part of the Premises.
5.5 Tenant is not allowed to keep pet.
5.6 Tenant must not do or permit to be done upon the Premised any illegal, unlawful or immoral purposes and not to do or permit to be done any act or thing which in the opinion of the Landlord may constitute a nuisance, this includes smoking in the common area, taking illegal drugs in the premises, hassling and disturbing other tenants; playing loud music, raising voice, causing an excessive amount of noise, creating disturbance to other tenant or neighbor. All should be quiet after 10.00pm
5.7 Tenant must not assign, sublet or part with the actual or legal possession or the use of the rooms or any part thereof to any person or persons
5.8 Tenant must not install or cause to be installed in the Premises equipment or electrical appliances consuming high voltage without the prior written consent of the Landlord first had and obtained;
5.9 Tenant must not store or bring upon the Premises arms, ammunition or unlawful goods, gunpowder, kerosene, gas tanks or any explosive or combustible or radioactive substances in any part of the Premises
6. Parking of Vehicles
6.1 Tenant has to ensure that his/her vehicle is parked in a proper place without causing obstruction to other Tenants or neighbors.
6.2 Tenant is also required to ensure that his/her visiting friends follow the parking rules.
6.3 In the event of any complaint received from neighbor or other tenant with regards to the Tenant’s parking, the Tenant will be subjected to a fine of RM100.00 and a personal apology to the affected party. Tenant is also solely responsible for the action of his/her visiting friends.
7. Tenant’s covenant for due care
7.1 Tenant shall use the facilities provided with due care. Any damages to furniture, fixtures and equipment, including doors, windows, class shutters, lock fastenings, electric wires, installations and fittings for the light and power,etc due to malicious, negligent or careless acts or omission of the Tenant or guests shall be borne personally by the Tenant.
7.2 Tenant shall not use the Room and/or Premises or any part thereof in such manner whereby dirt, rubbish or debris accumulates in or outside the Room and/or Premises.
8. To Allow Inspection and Repair
8.1 Tenant must permit the Landlord and the Landlord’s servants, agents and workmen and with all necessary equipment and appliances at all reasonable time to enter upon the room and to view the condition thereof and to do such works and things as may be required for any repairs, alterations or any other part of parts of the said building any defects for which the Tenant is liable.
9. Limitation of Landlord's Liability
9.1 The Landlord shall incur no liability to and shall not be liable in damages or otherwise to the Tenant for any damage, injury or loss which may, at any time during the term of the tenancy, be caused or suffered by the Tenant, its servants, agents, licensees and invitees or any of them or to any property of goods of the Tenant or of such persons as aforesaid in or about the Room and/or Premises occasioned by or arising from fire, water, storm, tempest, earthquake, insects, theft, burglary, explosion, riots, civil commotion or enemy action or by reason of the defective working, stoppage or breakage of any appliances, pipes, wires, cables, apparatus, air-conditioning or other machinery in or under or passing through or connected with or used for the purposes of the Demised Premises or any part thereof or failure of air-conditioning services, electricity or other supplies or owing to the act, default or omission of the Tenant, its servants, agents, licensees and invitees or occupiers of the Demised Premises or any of them.
9.2 For the safety of all tenants in the premise, each tenant must ensure that the main doors are kept securely locked at all times.
